Returns & Refund Policy

At Forty Four Merchandise, we strive to provide high-quality custom promotional products that meet our customers' expectations. Because the vast majority of our products are manufactured specifically to each customer's order, this Returns & Refund Policy explains when returns, replacements, and refunds are available.

Custom & Personalized Products (Final Sale)

All products sold by Forty Four Merchandise are custom-made or customized based on the specifications, artwork, branding, quantities, colors, and other details approved by the customer prior to production.

All custom, personalized, or made-to-order products are final sale and not eligible for return, refund, or exchange, except in cases of:

  • Manufacturing defects
  • Products damaged during shipping
  • Incorrect items shipped due to our error

This includes (but is not limited to):

  • Custom apparel
  • Printed merchandise
  • Promotional products
  • Items with customer-provided logos, text, or designs

Order Approval

Before production begins, customers receive a quote and/or digital proof for review and approval.

By approving your proof, you confirmed that:

  • All artwork, spelling, logos, colors, layout, sizing, and details are correct
  • You authorize us to proceed with production
  • You understand that no changes can be made after production begins

Forty Four Merchandise is not responsible for errors that were approved in the final proof. Due to differences in screens and production processes, slight variations in color, placement, or finish may occur. These are normal and do not constitute defects.

Customer Responsibilities

  • Customers are responsible for providing accurate artwork, logos, text, shipping addresses, and all other information necessary to fulfill an order.
  • Forty Four Merchandise is not responsible for errors contained in artwork or proofs that have been approved by the customer. Products manufactured in accordance with an approved proof are not eligible for return, replacement, or refund because of customer-approved errors.
  • Forty Four Merchandise is also not responsible for delayed, failed, or misdirected deliveries resulting from incorrect or incomplete shipping information provided by the customer. Orders affected by customer-provided shipping errors are not eligible for a refund or replacement.

Order Cancellations & Changes

  • Orders may be cancelled without charge only before production begins.
  • Once production has commenced, orders cannot be cancelled or changed because materials, labor, and manufacturing costs have already been incurred.

Returns and Refunds

Returns, replacements, or refunds will only be considered where:

  • the product contains a manufacturing defect;
  • the incorrect product was supplied due to an error by Forty Four Merchandise; or
  • the product was materially damaged during shipping.

Returns, replacements, or refunds will not be provided for:

  • customer-approved artwork, spelling, logos, colors, layout, sizing, or design errors;
  • dissatisfaction with a design or product that was approved prior to production;
  • incorrect or incomplete information provided by the customer, including shipping addresses or delivery instructions;
  • changes of mind after production has commenced;
  • normal manufacturing or printing tolerances, including slight variations in color, placement, dimensions, material, or finish; or
  • products that have been used, altered, or damaged after delivery.

Inspection of Orders

Customers should inspect their order promptly upon delivery.

Any claim relating to damaged, defective, or incorrect products must be submitted in writing within seven (7) business days after delivery and include photographs of the affected products.

Claims submitted after this period may not be accepted.

How to Submit a Claim

If you believe your order is defective, damaged, incorrect, or otherwise eligible for a replacement or refund under this Policy, please contact us at Inquiries@fortyfourmerchandise.com within the applicable claim period.

Please include:

  • your order number;
  • a detailed description of the issue;
  • photographs clearly showing the alleged defect, damage, or incorrect item; and
  • any additional information reasonably requested by Forty Four Merchandise to evaluate your claim.

We may request that the affected products be returned for inspection before processing your claim.

Due to the custom nature of the products we manufacture, custom or personalized products are not eligible for return, exchange, or refund because of a change of mind.

If Forty Four Merchandise offers any non-custom or stock products, those items may be returned within 30 days of the confirmed delivery date, provided they:

  • are unused and in their original condition;
  • are returned in their original packaging with all components included;
  • include the applicable order number; and
  • are otherwise eligible for return.

Customers are responsible for all return shipping costs unless the return results from an error by Forty Four Merchandise or the product is defective.

Items designated as Final Sale at the time of purchase are not eligible for return or exchange unless required by applicable law.

b. Defective, Damaged or Incorrect Items

If your order arrives defective, damaged, or you receive an incorrect product, you must notify Forty Four Merchandise within seven (7) days of the delivery date by emailing Inquiries@fortyfourmerchandise.com.

Where a claim is determined to be valid, Forty Four Merchandise may, in its sole discretion:

  • replace the affected product;
  • repair the product, where appropriate;
  • provide an exchange;
  • issue a partial refund; or
  • issue a full refund.

This Policy does not cover damage resulting from:

  • misuse or improper handling;
  • normal wear and tear;
  • improper storage or maintenance;
  • customer-approved artwork, spelling, logos, colors, sizing, layout, or design;
  • incorrect information provided by the customer, including shipping addresses or delivery instructions; or
  • customer dissatisfaction with a product manufactured in accordance with an approved proof.

Resolution of Claims

All claims will be reviewed on a case-by-case basis. If Forty Four Merchandise determines that a claim is valid, the remedy provided under this Policy shall be the customer's sole and exclusive remedy.

Where a refund is approved:

  • refunds will be issued to the original payment method used for the purchase;
  • original shipping charges will only be refunded where the return results from a manufacturing defect, shipping damage, or an error by Forty Four Merchandise;
  • return shipping costs will be covered by Forty Four Merchandise only where the return results from a valid warranty claim or our error; and
  • approved refunds will generally be processed within 7–14 business days following receipt and inspection of the returned product, where applicable.

Returns that do not satisfy the requirements of this Policy may be refused.

Shipping Damage

If products arrive visibly damaged, customers should:

  • note the damage with the delivery carrier where possible;
  • retain all packaging materials; and
  • notify Forty Four Merchandise within seven (7) business days of delivery.

Failure to preserve the packaging or timely report shipping damage may affect our ability to process the claim. Failure to report shipping damage to the carrier at the time of delivery may result in denial of the claim.

Incorrect Shipping Information

Customers are responsible for providing accurate shipping details.

  • Orders returned due to incorrect addresses will require reshipping at the customer's expense.
  • We are not responsible for lost or delayed shipments due to incorrect information.
  • If a package is refused at delivery, you will be responsible for return shipping and any carrier fees; refunds (if applicable) may be reduced accordingly.

Manufacturing Variations

Due to the custom manufacturing process, slight variations between the approved proof and the finished product may occur, including variations in color, print placement, dimensions, material, engraving, embroidery, or other finishing processes. These variations are commercially acceptable and do not constitute defects.

Limitation of Liability

To the fullest extent permitted by applicable law, Forty Four Merchandise's liability arising from any order or claim shall not exceed the amount paid by the customer for the affected products.

Forty Four Merchandise shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, business interruption, missed events, or loss of goodwill.
